1. Introduction

Welcome to Aspira Prism, operated by ASPIRA EDTECH LLP (LLPIN - ACZ-3224) ("Company", "we", "our", "us"). These Terms & Conditions govern your use of our website, applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these terms. If you disagree with any part of the terms, you may not access the Services.

2. Intellectual Property Rights

Other than the content you own, under these Terms, ASPIRA EDTECH LLP and/or its licensors own all the intellectual property rights and materials contained in our Services. This includes our proprietary flashcard systems, AR Studio technologies, mock tests, and cognitive training modules. You are granted a limited license only for purposes of viewing the material contained on our platform.

3. Restrictions

You are specifically restricted from all of the following:

• Publishing any platform material in any other media without prior consent.
• Selling, sublicensing, and/or otherwise commercializing any platform material.
• Publicly performing and/or showing any platform material.
• Using this platform in any way that is or may be damaging to the platform.
• Using this platform in any way that impacts user access to the platform.
• Engaging in any data mining, data harvesting, data extracting, or any other similar activity in relation to this platform.

4. Minors & Parental Supervision

Our platform offers educational content tailored for school students (including Classes 6-8). If you are under 18 years of age, you may only use Aspira Prism with the active involvement and consent of a parent or legal guardian. By allowing a minor to use the platform, the parent or legal guardian accepts full legal and financial responsibility for the minor's actions, including any purchases made.

5. Creator Studio & User-Generated Content (UGC)

Users may create, upload, and share flashcard decks, mock tests, and AR Studio documents ("User Content"). You retain ownership of your User Content. However, by uploading it, you grant ASPIRA EDTECH LLP a worldwide, royalty-free, non-exclusive license to host, display, and distribute this content on the platform.

Copyright Safe Harbor: Aspira does not actively monitor all user uploads and is not legally liable for copyrighted material unlawfully uploaded by users. If you are a copyright owner and believe your intellectual property has been infringed upon, please contact us at support@aspira.net.in. We will investigate and remove infringing content in a timely manner.

6. Content Accuracy Disclaimer

While we strive to provide high-quality educational resources, all content, mock tests, and data on Aspira Prism are for supplementary learning purposes. ASPIRA EDTECH LLP cannot be held liable for any inaccuracies, errors, omissions, or discrepancies in the content. We do not guarantee specific academic outcomes or exam results resulting from the use of our platform.

7. Accounts and Subscriptions

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

Certain parts of the Service are billed on a subscription basis ("Subscriptions") or via one-time digital purchases. You will be billed in advance on a recurring and periodic basis depending on the type of subscription plan you select.

8. Mindspace Sessions

Our Mindspace feature offers 1:1 mentorship and psychological sessions. Users must adhere to professional conduct during these sessions. Please refer to our Refund Policy for details on cancellations and no-shows regarding Mindspace credits.

9. Limitation of Liability & Force Majeure

In no event shall ASPIRA EDTECH LLP, nor its officers or employees, be held liable for anything arising out of your use of this platform. We shall not be liable for any indirect, consequential, or special liability.

Force Majeure: We are not liable for any service interruptions, data loss, or downtime caused by circumstances beyond our reasonable control, including but not limited to server outages, natural disasters, or government-mandated internet blackouts.

10. Governing Law, Jurisdiction & Dispute Resolution

These Terms will be governed by and interpreted in accordance with the laws of India. You agree that any dispute, claim, or matter arising out of or relating to your use of the Services or these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Charkhi Dadri, Haryana, India, and no other courts shall have jurisdiction.

Class Action Waiver: You agree that any disputes against Aspira EdTech LLP must be brought on an individual basis only, and not as a plaintiff or class member in any purported class or representative proceeding.

Severability: If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.
